Offshore Trusts

The AMS Group is able to provide a full range of trust services in both the British Virgin Islands and Nevis through its licenced trust companies in each jurisdiction.  The Group has close working relationships with legal, accounting and other professionals worldwide involved in the formation of offshore trusts. As a result of this, the Group is able to access comprehensive advice with respect to the set up and administration of trusts. This ensures that the trust is compliant with not only the laws of the British Virgin Islands (or Nevis as appropriate) but also the laws of the jurisdictions in which the settlor and the beneficiaries are resident or domiciled.

The general law of both the British Virgin Islands and Nevis is derived from the English Courts of Equity. The trust laws in both jurisdictions have been modified by statute. The trust law in the British Virgin Islands is considered to be of a more traditional nature compared to the trust law in Nevis which includes technical provisions providing for enhanced asset protection.
